1. Agreement to Terms

By accessing or using GetMyRunPhotos ("the Service"), operated by MyRunPH IT Solutions, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

GetMyRunPhotos is an event photography marketplace that connects people with event photographers. The Service provides AI-powered photo search (face detection and bib number recognition), photo purchasing, and digital delivery of high-resolution event photos.

3. User Accounts

3.1 Registration

You must create an account to purchase photos or upload photos as a photographer. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Account Types

  • Find My Photos — Can browse events, search for photos, and purchase event photos
  • Photographer — Can upload event photos and earn revenue from photo sales
  • Organizer — Can browse events and view event photo statistics as an official partner (available by agreement or contact basis)
  • Admin — Platform administrators who manage the Service, users, and content

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the Service.

4. Photo Purchases

4.1 Pricing

Photo prices are set by GetMyRunPhotos and may change without prior notice. Bulk pricing discounts (Multi-Pack, Bundle Deal) are applied automatically at checkout.

4.2 Payment

Payments are processed through PayMongo. We accept GCash, Maya, and credit/debit cards (Visa, Mastercard). All prices are in Philippine Pesos (PHP).

4.3 Digital Delivery

After successful payment, high-resolution photos without watermarks are available for download from your "My Photos" page. Downloads are available indefinitely for your purchased photos.

4.4 Refund Policy

Due to the digital nature of our products, all sales are final. Refunds may be considered on a case-by-case basis for technical issues (e.g., corrupted files, incorrect photo delivered). Contact [email protected] for refund requests.

5. Photographer Terms

5.1 Photo Uploads

By uploading photos to the Service, photographers confirm they own the copyright to the photos and have the right to distribute them. Photographers grant GetMyRunPhotos a non-exclusive license to display, watermark, and sell the photos through the platform.

5.2 Revenue Share

Photographers earn a percentage of each photo sale as specified in their photographer dashboard. Revenue share percentages may be updated with notice. Earnings are tracked in the photographer dashboard and paid out according to the payout schedule.

5.3 Purchased Photo Protection

Photos that have been purchased by buyers cannot be deleted by photographers. These photos will remain accessible to the buyers regardless of whether the photographer removes other photos from their album.

5.4 Content Standards

Photographers must only upload legitimate sports event photos. Content that is offensive, inappropriate, or unrelated to sports events will be removed, and the photographer's account may be suspended.

6. Intellectual Property

6.1 Photo Copyright

Copyright of event photos remains with the original photographer. Purchasing a photo grants the buyer a personal, non-commercial license to use the photo (e.g., sharing on social media, printing for personal use). Buyers may not resell, sublicense, or use purchased photos for commercial purposes without the photographer's written consent.

6.2 Platform Content

The GetMyRunPhotos name, logo, design, and all platform content (excluding user-uploaded photos) are owned by MyRunPH IT Solutions and protected by intellectual property laws.

7. AI-Powered Features

Our Service uses AI technology for face detection and bib number recognition. While we strive for accuracy, these features may not always produce perfect results. We are not liable for missed matches or incorrect identifications. Face data (embeddings) is used solely for photo matching and can be deleted at any time.

8. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to remove or circumvent watermarks on preview images
  • Scrape, crawl, or use automated tools to download content
  • Upload content you do not have the right to distribute
  • Impersonate another person or misrepresent your identity
  • Interfere with the proper functioning of the Service
  • Use purchased photos for commercial purposes without authorization

9. Limitation of Liability

GetMyRunPhotos and MyRunPH IT Solutions are provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be resolved in the courts of the Philippines.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or a notice on the website.
